Contracting in IP R&D and commercialisation arrangements is all about managing risk.  It is therefore critical for commercial managers and advisers to have a working understanding of the types of risks that arise in IP contracting and how best to deal with them.

Take this opportunity to learn from an experienced IP practitioner who has managed risk both as a lawyer and as a commercial manager.  The workshop will be hands on, utilising practical tools to identify, assess and manage risk in a number of IP scenarios.  You will come away with a simple framework and easy to understand tools to help you manage risk in your day to day work, as well as an understanding of industry practice in this important area, including:

To Jump or not to Jump

This practical workshop will use an actual case study to decide whether to licence out IP or grow a business organically.

Commercialisation Managers and IP Lawyers are often asked to assist in making decisions about the appropriate way to commercialise technology (or value technology). Using the Ocloc Vineyard Post Repair System as an example, Simon Dalgarno from Leadenhall will work through the financial analysis used to assist the owners of the Ocloc systems make decisions regarding the most appropriate commercialisation strategy.

Key questions included:

  • maximum sales with and without a distribution partner;
  • take up rates with and without a distribution partner;
  • market evidence of royalty rates;
  • royalty rates established from base principals;
  • relative riskiness and required rates of return; and
  • the required up front cost of commercialisation.

A copy of the excel model used in the evaluation will be provided to participants for them to use in the analysis of similar decisions.
